  • Obama has already stated that future members of the Court would resemble Justice Ginzberg. Since he taught constitutional law, he should be very familiar with the constitution. There are federal laws on the books to implement that treaty. These laws allow for the prosecution of any American that commits a war crime, even outside the jurisdiction of US law. The Constitution is very clear about cruel and unusual punishment. Many members of the Bush Administration, including Bush, should have been in jail years ago. They will need to watch where they are trveling overseas after they leave office. Charges can be brought against them in any country that signed the Geneva Convention. One Israeli general had to hide in the bathroom of his plane when he arrived in England because of the threat of arrest. He returned to Israel on the same plane.
