Rethinking the Death Penalty

The article focuses on the issue of the execution of mentally retarded offenders. The Supreme Court has withdrawn its support of death sentences for those death row inmates with limited intellectual capacity. U.S. District Judge Jed Rakoff declared that the Federal Death Penalty Act is unconstitutional due to the risk of executing innocent people. According to California U.S. District Judge Thelton Henderson, capital punishment in the state violates the Eighth Amendment ban on cruel and unusual punishment. The ruling of the Court regarding the issue was an effort to save the life of Daryl Atkins, who have an IQ of 59 and was allegedly involved in an ATM robbery.
